Terms of Service

These Terms govern your access to and use of ViewerFX (the "Service"), operated by GeoGear Supply ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

The service

ViewerFX lets you upload point cloud files (LAS, LAZ, E57, PLY, PCD, PTS, PTX), converts them to a streaming format, and lets you share an interactive web viewer with people you choose. Features and limits depend on your plan.

Accounts

You are responsible for your account, your password, and all activity under it. Provide accurate information and keep it current. You must be able to form a binding contract to use the Service.

Emails we send

Some emails are part of running your account and cannot be switched off while the account exists: upload and conversion results, share link activity, receipts and billing notices, security and sign-in messages, and notices about changes to these Terms or the Service.

Separately, we send product news, point cloud tips, and occasional offers. These are on by default when you create an account and are optional: every such email carries a one-click unsubscribe link, and you can turn them on or off at any time from your account page. Unsubscribing never affects the account emails above.

Plans, billing, and cancellation

• The free plan is free. Paid plans are billed monthly or yearly in advance through Stripe, and start with a free trial when the account is eligible for one.
• Every plan includes one admin seat. Additional admin and user seats are added from your account, billed with the plan on the same schedule, and prorated when the count changes. Members you invite use the workspace under these Terms; you are responsible for who you invite.
• You can switch plans or cancel anytime from your account. Cancellation takes effect at the end of the current billing period, and your shared links keep working until then.
• Fees are non-refundable except where required by law. Plan limits (storage, stored file count) are described at signup and on the pricing page.
• We may change pricing with reasonable notice. Changes do not affect the period you have already paid for.

Your content

You retain all rights to the files and data you upload ("Your Content"). You grant us a limited license to store, process, convert, and transmit Your Content solely to provide the Service to you and the people you share with. You are responsible for having the rights to upload and share Your Content, and for what you choose to make accessible through share links.

We do not use Your Content in our own marketing unless you switch on the "feature this project" permission for a specific file. When you do, you grant us a non-exclusive, royalty-free license to display that file, and stills or recordings of it in the viewer, in ViewerFX marketing such as the examples page, advertisements, and social media, with credit to you. You can switch the permission off at any time; we stop using the file in new material from then on.

Acceptable use

You agree not to use the Service to:

• Upload content you do not have the right to use, or that is unlawful or infringing.
• Attempt to breach security, access other users' data, or disrupt the Service.
• Resell or white-label the Service except as expressly permitted by your plan.

Availability

We work to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features. We are not a backup service: keep your own copies of your original files.

Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. Measurements, volumes, and other viewer outputs are estimates for visualization and review, not certified survey deliverables. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.

Termination

You may stop using the Service anytime. We may suspend or terminate access for violation of these Terms. On termination we may delete Your Content after a reasonable period.

Changes

We may update these Terms. Material changes will be posted here with an updated date, and accounts are notified by email. Continued use after changes means you accept them.
